Hey, it’s Jani. Welcome to my site. I hope you enjoy your time here. To make sure we’re all on the same page (pun intended), I’ve put together a few rules to help you understand and navigate the content of my webpage.

I take all reasonable steps to ensure the Website and the services here are available without interruptions. However, the Website may encounter downtime due to server and other technical issues. I cannot promise that access to the services will be uninterrupted or error free. Therefore, JNVP will not be liable if the Website or the services provided here are unavailable.

This Website is to be used by you for your personal use only. Commercial use of this Website is strictly prohibited unless prior written consent from JNVP has been obtained.

No license or right to or in any such copyrights, trademarks, patents, designs, trade secrets, products or other proprietary rights of JNVP and/or other parties is granted to or conferred to you.

Except as expressly provided in these terms and conditions, no part of the Website and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, translated, transmitted or distributed in any other way (including mirroring) to any other computer, server, website or other medium for publication or distribution or for any commercial enterprise, without a prior written consent from JNVP. You may not use any framing techniques to frame any JNVP and “Jani Nendl” trademarks, logos or other proprietary information, nor use any metatags or other hidden text utilizing the JNVP and “Jani Nendl” name, trademark or other proprietary information.

You agree that you use this Website at your own risk. The Website and the Content is provided on an “as is” basis without warranties of any kind.

In no event, but subject to what is permitted under applicable law, JNVP, its agents, representatives or licensors shall not be liable to you or any other party for any loss or injury or any damages, either direct, indirect, punitive or otherwise resulting from or in any way connected to your use of this Website or any of the services offered here.

Processing of personal data:

Who is the data controller?

What personal data to we collect and process?

JNVP collects personal data about you in these situations:

  1. When you visit our website – JNVP stores and processes information about how you use our site. The purpose is to improve your user experience.

  2. When you subscribe to my newsletter - JNVP store and process first name, surname, email, country and additional information that you can choose to provide to JNVP such as address, interests, products, etc. JNVP also stores information about how you use the newsletter, for example if you read it or not. The purpose is to adapt and improve how I treat you as a customer and my service to you.

  3. When you enter into a binding agreement with me for the purchase of my products and services. JNVP will store and process your first name, surname, email, address, country of residence, phone number, tax information (if required) and any additional information you choose to provide to JNVP to complete a transaction or otherwise exercise your rights as a buyer of my products and services.

How do I use your personal data?

The personal data I collect will be used:

  • To send newsletters, offers and other news about JNVP’s latest services, products, events, product launches, If you do not want to be on my mailing list, you can opt out by simply clicking the unsubscribe link at the bottom of the newsletters.

  • To learn about how you use my website and why so that I can optimise your experience while visiting.

  • To ensure that my products and services are delivered to you appropriately and that you can exercise your rights as a buyer of my products and services.

How do I disclose your personal data to third parties? 

JNVP may disclose and share personal data with JNVP’s service providers, namely companies who provide services such as information processing, fulfilling customer orders, delivering products to you, managing and enhancing customer data, providing customer service, assessing your interest in my products and services, accounting and conducting customer research or satisfaction surveys. These companies are obligated to protect your personal data according to data processing agreements.

JNVP may − by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence – have to disclose your personal data if applicable legislation binds JNVP to disclose such data. JNVP may also disclose information about you if necessary for purposes of national security, law enforcement or other issues of public importance.

For how long do I save your personal data?

I will retain your personal data for five (5) years after your last contact with me. If you have purchased one of my products, I retain the necessary personal data during the product's life and warranty period.

What are your rights?

Upon your request, JNVP will rectify your data. If certain conditions are met, JNVP will erase your data or restrict the processing of your data upon request to the extent not necessary to perform any binding agreements between you and JNVP regarding the sale and purchase of my products and services. JNVP is also obligated to, upon your request, confirm whether personal data regarding you is being processed as well as give you access to information regarding the processing. You also have the right to receive personal data that has been provided by you to JNVP in a structured, commonly used and machine readable format. JNVP is obligated to meet a request from you regarding these rights within a 30-day period. This period may in some cases be extended. All requests can be made by email: info@janinendl.com.

If you experience an infringement of your rights according to the GDPR, you have a right to lodge a complaint with the relevant supervisory authority of your country of residence, or to The Slovene Information Commissioner, (https://www.ip-rs.si/en/).

Transfer to third countries

Personal data may be transferred or accessed by other companies in other countries for the purposes and according to what is described in these Terms of use. Transfers to third countries are made in accordance with the provisions in Chapter V of the GDPR. Where necessary, JNVP uses the standard data protection clauses adopted by the Commission to ensure safe transfer to third countries.

Chapter four - Miscellaneous

Severability

If any provision in these terms and conditions is determined to be unenforceable or invalid, such provision shall be enforceable to the extent permitted by applicable law and such determination of the provision shall not affect the validity of any other remaining provision.

No waiver

No failure or delay by JNVP to exercise any right, power or privilege under these terms and conditions shall operate as a waiver thereof.

Governing law

Any disputes arising out of or in connection with the use of this Website or the services offered on the same, shall be governed by and construed and enforced in accordance with the substantive laws of the Republic of Slovenia. Any claims or disputes whatsoever arising hereunder shall be submitted to the exclusive jurisdiction and venue of the courts of Slovenia.
